1. Who we are
Entivaro is operated by Entivaro LLC, a Florida limited liability company ("Entivaro," "we," "us"). These terms apply when your agency ("you") subscribes to or receives any Entivaro report, list, file or sample (the "Data").
2. What you get
A recurring report of new businesses in the county or counties on your plan, built from public records, with the business phone number and email address where one appears in a public filing. Report contents, format and delivery day may change as we add sources, but the core service described on your plan will not be removed during a paid billing period.
3. Billing, renewal and cancellation
- Plans are prepaid monthly or annually and renew automatically at the end of each billing period until you cancel.
- You can cancel at any time from your billing portal or by emailing us. Cancellation takes effect at the end of the period you have already paid for. You keep access until then.
- We do not give refunds or credits for partial billing periods, except where the law requires it or where we fail to deliver a report you paid for.
- We will email you before any price change takes effect, and the new price applies only from your next billing period.
- Free samples are provided once per agency, carry no obligation and do not convert into a paid plan unless you choose to subscribe.
4. How you may use the Data
- Business marketing and prospecting by your agency and its own producers only.
- You may not resell, publish, share or give the Data to anyone outside your agency, or combine it into a product you sell.
- Not a consumer report. Entivaro is not a consumer reporting agency. You may not use the Data, in whole or in part, to decide anyone's eligibility for credit, insurance, employment or housing, for underwriting or rating, or for any other purpose covered by the Fair Credit Reporting Act.
5. Your outreach is your responsibility
You are solely responsible for how you contact businesses listed in the Data, including compliance with the Telephone Consumer Protection Act, the National Do Not Call Registry, the Florida Telephone Solicitation Act (Fla. Stat. § 501.059) and Florida's Do Not Call list, CAN-SPAM, and any other law that applies. Many small-business numbers are owners' personal cell phones. Scrub numbers against applicable Do Not Call lists and obtain any consent the law requires before texting or using automated dialing.
6. Accuracy
The Data comes from public records, which can lag, change or contain errors. We check records and correct mistakes we find, but the Data is provided "as is" and "as available," without warranties of any kind, including accuracy, completeness or fitness for a particular purpose. A Strong Signal means two independent public records point to the same new business; it is not a guarantee that the business will open, buy insurance or buy from you.
7. No exclusivity
Lists are not exclusive. Other subscribers may receive the same businesses.
8. Limitation of liability
To the fullest extent the law allows, Entivaro will not be liable for any indirect, incidental, special, consequential or lost-profit damages, and our total liability for any claim relating to the Data or these terms is limited to the fees you paid us in the 12 months before the claim arose.
9. Indemnity
You agree to defend and hold Entivaro harmless from claims, fines and costs arising from your use of the Data in violation of these terms or of any law, including telemarketing and email laws.
10. Ending access
We may suspend or end your access if you breach these terms, including by sharing or reselling the Data or using it for an eligibility decision. If we end a plan for reasons other than your breach, we will refund the unused portion of any prepaid period.
11. Changes to these terms
We may update these terms. We will post the new version here with a new effective date and email active subscribers about material changes at least 14 days before they take effect.
12. Governing law
These terms are governed by Florida law. Any dispute will be brought in the state or federal courts located in Alachua County, Florida.
